3. License and Usage Rights

3.1 License Grant

Subject to these Terms, we grant you a non-exclusive, non-transferable, limited license to use the Software on a single computer for your personal or business use.

3.2 License Types

We offer two license types:

Basic License: Includes core email marketing features for small businesses and startups
Premium License: Includes all Basic features plus advanced functionality, integrations, and priority support

3.3 Restrictions

You may not:

Copy, modify, or distribute the Software
Reverse engineer, decompile, or disassemble the Software
Use the Software for illegal or unauthorized purposes
Transfer your license to another person or entity
Use the Software on multiple computers with a single license

4. Payment and Pricing

4.1 One-Time Payment

MailIris uses a one-time payment model. You pay once for your license and own the software forever. There are no monthly or annual subscription fees.

4.2 Upgrade Fees

After the free upgrade period ends:

Basic License: $10 per year for continued updates and new features
Premium License: $20 per year for continued updates and new features

Upgrade fees are optional. You can continue using your current version without additional costs, but you won't receive new features or security updates.

4.3 Refund Policy

We offer a 30-day money-back guarantee. If you're not satisfied with MailIris within 30 days of purchase, contact us for a full refund.

5. User Responsibilities

5.1 Compliance with Laws

You are responsible for ensuring that your use of MailIris complies with all applicable laws and regulations, including but not limited to:

Email marketing regulations (CAN-SPAM, GDPR, etc.)
Data protection and privacy laws
Intellectual property rights
Anti-spam and anti-fraud regulations

5.2 Content and Data

You are solely responsible for the content of your email campaigns and the accuracy of your contact data. We do not review, monitor, or validate your content or data.

5.3 Account Security

You are responsible for maintaining the security of your computer and preventing unauthorized access to the Software and your data.

6. Privacy and Data Protection

Your privacy is important to us. MailIris processes all your email marketing data locally on your computer. We do not have access to your contact lists, campaign data, or email content.

Your license includes a free period for automatic updates:

Basic License: 1 year of free automatic updates

Custom development or modifications
Training or consulting services
Data migration from other platforms
Third-party integration support

8. Disclaimers and Limitations

8.1 Software Availability

The Software is provided "as is" without warranties of any kind. We do not guarantee that the Software will be error-free or uninterrupted.

8.2 Limitation of Liability

In no event shall MailIris be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

8.3 Maximum Liability

Our total liability to you for any claims arising from these Terms or your use of the Software shall not exceed the amount you paid for your license.

9. Termination

These Terms remain in effect until terminated. You may terminate these Terms by uninstalling the Software and ceasing all use.

We may terminate these Terms if you breach any provision. Upon termination, your license to use the Software ends, and you must uninstall the Software.

Provisions that by their nature should survive termination (including privacy, intellectual property, and liability limitations) shall remain in effect.

10. Intellectual Property

MailIris and all related content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your content and data. By using the Software, you grant us a limited license to use anonymized, aggregated data for improving our services.

11. Third-Party Services

MailIris may integrate with third-party services (e.g., email providers, payment processors). Your use of these services is subject to their respective terms of service and privacy policies.

We are not responsible for the availability, accuracy, or content of third-party services.

12. Governing Law and Disputes
